Terms of Service

Last updated: October 2026

These Terms of Service (the "Terms") are a binding agreement between you and SpotApply LLC, an Ohio limited liability company ("SpotApply", "we", "us", "our"). By creating an account or using SpotApply (the "Service"), you agree to these Terms. Please read them carefully — they limit our liability and say where disputes are decided.

1. Who we are

The Service is provided by SpotApply LLC, an Ohio limited liability company located at 3227 Bishop Street, Unit 7, Cincinnati, OH 45220, United States. SpotApply LLC is the company you are contracting with and is solely responsible for the Service. No member, officer, employee or agent of SpotApply LLC is personally a party to these Terms.

2. The service

SpotApply is an AI-powered job search automation tool. It discovers job listings from public job boards and ATS platforms, scores them against your resume, and auto-fills application forms on your behalf — subject to your explicit approval before any submission.

3. Your responsibilities

  • You must be at least 18 years old to use the Service. We do not knowingly collect personal data from anyone under 18; if we learn an account belongs to someone under 18, we delete it.
  • You are responsible for the accuracy of your profile and resume data.
  • You must review every application before approving submission. SpotApply submits nothing without your explicit approval: either you click Submit on the employer's form, or, with One-click submit turned on, your click on Apply & Submit for that application is your approval (see section 4).
  • You agree not to misuse the Service to submit false, misleading, or fraudulent applications.

4. Third-party platforms

SpotApply reads job listings from public applicant-tracking boards and feeds (Greenhouse, Lever, Ashby, Workday, SmartRecruiters, Workable and similar), public job-board APIs, and licensed aggregators. We do not scrape LinkedIn or Indeed and we never sign in to any job platform on your behalf. Listings that originate on those sites reach us through a licensed aggregator or a public feed and are shown to you as links you open yourself.

Auto-fill types your answers into an application form that you have opened, in your own browser session, and stops there — you review and click Submit. You remain the applicant and are responsible for what you submit, including the accuracy of every tailored document.

One-click submit is an optional setting, off by default. When it is on, clicking Apply & Submit for an application instructs the browser extension to fill that one application and press the form's own Submit button in your browser. It does so only on application pages that need no account (currently Greenhouse, Lever, Ashby and SmartRecruiters boards), only when every required field has an answer and your resume is attached, and never when the page shows a CAPTCHA, asks you to sign in, or rejects a field; in those cases it stops, leaves the tab open and tells you. We never solve or bypass a CAPTCHA, never create accounts or store passwords for you, and never submit anything you did not click Apply & Submit for. Each such click counts as your review and approval of that application, and a daily limit applies. You can turn the setting off at any time. Before the extension presses Submit it shows a five-second countdown you can stop, and it records the application as submitted only when the employer's site confirms it or you tell us so; submitting through SpotApply does not guarantee that the employer's system receives or processes the application. You remain the applicant and the party to each job board's terms: SpotApply acts only in your browser, at your instruction, and stops whenever a site asks for a person. We never submit on LinkedIn, Indeed or any site that requires you to sign in, and we do not promise that software-assisted applications are undetectable — some employer systems label them.

  • You are responsible for complying with the terms of each employer or platform you apply through.
  • SpotApply does not guarantee that any application will be accepted, read, or answered.

5. AI-generated documents

Tailored resumes and cover letters are written by AI models from your own resume and the job posting. We check each draft against your master resume and withhold a draft that states experience your resume does not show, but no automated check is perfect. Read every document before you send it — you are responsible for what you submit.

6. Plans and payments

SpotApply offers a Free plan with daily limits and a paid Pro plan at the price shown on the Pricing page, billed monthly in advance through Stripe. There are no other fees.

Pro renews automatically. Pro will be a monthly subscription that renews automatically every month until you cancel. Its price has not been set yet: it will be shown next to the subscribe button and on the payment page before anyone can pay, and no one is moved onto a paid plan automatically. Cancel anytime online in your dashboard under Plans & Pricing → Manage or cancel subscription; you will keep Pro until the end of the month you paid for and are not charged again. We show these terms next to the subscribe button and on the payment page before you pay. Refunds are covered by our Refund Policy.

While we show a notice that Pro features are temporarily available to everyone, every account receives Pro limits at no charge. Nothing is charged during that time, and you are not enrolled in a paid plan when it ends. Limits and features may change as the Service develops.

7. Automatic job search

SpotApply searches and ranks new jobs for you in the background. To keep the Service fair and affordable, this background work pauses when your account has had no meaningful activity for a while (a tab left open does not count). Your board, resume and history are kept, and you can resume at any time from the dashboard or pause it yourself from Settings.

8. No employment guarantee

SpotApply automates the application process but makes no guarantee of job offers, interviews, or responses from employers. Results depend on your profile, the job market, and employer decisions outside our control. Match scores and similar signals are estimates produced by automated models; they are informational only.

9. Intellectual property

You retain all rights to your resume, profile data, and any documents you upload. By using the Service, you grant SpotApply LLC a limited, non-exclusive license to process and store that content solely to provide the Service to you. The license ends when you delete the content or your account.

The Service itself — its software, interfaces and branding — remains the property of SpotApply LLC.

9a. Content you post

Only upload content you have the right to use — for example a profile photo of yourself and your own resume. Do not upload anything that infringes someone else's copyright or other rights, or that is unlawful, abusive or misleading. We may remove such content and suspend accounts that repeatedly post it.

If you believe content on SpotApply infringes your copyright, send a notice to our designated agent at legal@spotapply.ai (subject line "DMCA notice"), or by mail to SpotApply LLC, Attn: Copyright Agent, 3227 Bishop Street, Unit 7, Cincinnati, OH 45220, United States. Include: (1) your physical or electronic signature; (2) the work you say is infringed; (3) the material you want removed and where it is (a link is best); (4) your name, address, telephone number and email; (5) a statement that you have a good-faith belief the use is not authorised by the copyright owner, its agent or the law; and (6) a statement, under penalty of perjury, that the notice is accurate and that you are the owner or authorised to act for the owner. We remove material that is the subject of a valid notice and terminate the accounts of repeat infringers. If your content was removed and you believe that was a mistake, you can send a counter-notice to the same address.

10. Service availability

We strive for high availability but do not guarantee uninterrupted service. Scheduled maintenance, third-party outages, or unexpected failures may cause temporary downtime.

11. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPOTAPPLY LLC DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. We do not warrant that the Service will be error-free, that AI-generated content will be accurate or suitable, or that a job listing is genuine, current or still open.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPOTAPPLY LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES AND AGENTS ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, MISSED JOB OPPORTUNITIES, THIRD-PARTY PLATFORM ACTIONS OR DATA LOSS, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.

13. Indemnification

You agree to indemnify and hold harmless SpotApply LLC and its members, officers, employees and agents from any claim, loss, liability or expense (including reasonable attorneys' fees) arising out of your misuse of the Service, your violation of these Terms or of a third-party platform's terms, or the content of any application you choose to submit.

14. Termination

You may delete your account at any time from Settings → "Delete my account". We reserve the right to suspend or terminate accounts that violate these Terms or are used for fraudulent purposes. Sections 9 and 11 through 15 continue to apply after your account ends.

15. Governing law and disputes

These Terms are governed by the laws of the State of Ohio, United States, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service must be brought exclusively in the state or federal courts located in Hamilton County, Ohio, and you consent to the personal jurisdiction of those courts.

You and SpotApply LLC each agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any class or representative action.

16. Changes to these terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the new Terms. We will notify you of material changes via email.
